Terms of Service

These Terms of Service (“Terms”) govern your use of nationalclaimsnegotiators.com (the “Site”) and our communications with you, including web chat and text messages. The Site is operated by National Claims Negotiators LLC (“NCN,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

About our services

NCN is a licensed public adjuster company. A public adjuster represents the policyholder, not the insurance company, in preparing, presenting, and negotiating a property insurance claim. We hold licenses in the states listed on the Site, and our license information appears in the Site footer. We provide public adjusting services only where we are licensed or otherwise permitted by law.

Contacting us, requesting a free claim review, or chatting with us does not create a contract for our services. If we agree to represent you, the terms of that engagement, including our fee, are set out in a separate written agreement that you sign. That agreement controls over these Terms for the services it covers.

No legal advice; no guarantee of results

Content on the Site, including blog posts, case results, statistics, and chat or text responses, is general information only. It is not legal, financial, engineering, or insurance advice, and it does not create an attorney-client relationship. NCN and its public adjusters are not attorneys. If you need legal advice, consult a licensed attorney.

Past results and client reviews do not guarantee a particular outcome on your claim. Every claim depends on its own facts, policy terms, and applicable law.

Text message terms (SMS program)

By providing your mobile phone number and checking the consent box on our contact form, or by otherwise agreeing to receive texts from us, you agree to receive text messages from National Claims Negotiators LLC at that number. These terms apply to those messages.

• Program description. We send text messages about your claim review request and claim, such as responses to your inquiry, appointment scheduling and reminders, claim status updates, and requests for information or documents.
• Consent is optional. Consent to receive text messages is not a condition of purchasing any goods or services, and you can request a claim review without agreeing to texts.
• Message frequency. Message frequency varies depending on your inquiry and the status of your claim.
• Costs. Message and data rates may apply, according to your mobile plan.
• Opt out. Reply STOP at any time to cancel. You will receive a confirmation message, and we will not send further texts unless you ask us to. You can also tell us by phone at (817) 969-4621 or by email at claims@ncnmail.com.
• Help. Reply HELP for assistance, or contact us at (817) 969-4621 or claims@ncnmail.com.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed.
• Privacy. We handle your information as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Please do not send sensitive information, such as Social Security numbers or financial account numbers, by text message.

Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

• submit false, misleading, or another person's information;
• interfere with or disrupt the Site or its security;
• use automated tools to scrape the Site or submit forms in bulk; or
• use the Site in any way that violates applicable law.

Intellectual property

The Site and its content, including text, graphics, logos, and design, belong to NCN or its licensors and are protected by intellectual property laws. You may view and share links to the Site for personal, non-commercial use. You may not copy, modify, or republish Site content without our written permission.

Third-party links and services

The Site may link to third-party websites and use third-party tools, such as our chat widget. We do not control those sites or tools and are not responsible for their content or practices.

Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.

Limitation of liability

To the fullest extent permitted by law, NCN and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or reliance on its content. This limitation applies to use of the Site only and does not change the terms of any separate written agreement for our services.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from your use of the Site will be brought in the state or federal courts located in Tarrant County, Texas, and you consent to that jurisdiction, unless applicable law requires otherwise.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they were last changed. Continued use of the Site after an update means you accept the updated Terms.
